1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Singapore Ecommerce Centre Pte Ltd (“we,” “us” or “our”), concerning your access to and use of the Health AI application as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

2. Intellectual Property Rights

Unless otherwise indicated, the Site and the Application are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

3. User Representations

By using the Site, you represent and warrant that:

  • All registration information you submit will be true, accurate, current, and complete.
  • You will maintain the accuracy of such information and promptly update such registration information as necessary.
  • You have the legal capacity and you agree to comply with these Terms and Conditions.
  • You are not a minor in the jurisdiction in which you reside.
  • You will not access the Site through automated or non-human means, whether through a bot, script or otherwise.
  • You will not use the Site for any illegal or unauthorized purpose.

4. Medical & Fitness Disclaimer

IMPORTANT: WE ARE NOT DOCTORS OR PROFESSIONAL HEALTH COACHES.

The Health AI application provides information, estimations, and tools for tracking health and fitness metrics based on data you input. It is not a medical device and should not be used to diagnose, treat, cure, or prevent any medical condition.

The content provided, including AI-generated insights, nutritional estimations, and workout suggestions, is for informational and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition, diet change, or new exercise regimen. Never disregard professional medical advice or delay in seeking it because of something you have read on this Application.

5. AI Technology & Third-Party Processing

⚠️ Consent to AI Processing of Your Data

Our Application uses Artificial Intelligence (AI), specifically Google Gemini (a large language model operated by Google LLC), to analyse food images and estimate nutritional content. By using the AI food scanning feature, you expressly acknowledge, consent to, and agree that:

  • Your food images will be sent to Google's servers for processing. When you capture or upload a food photo for AI analysis, the image is transmitted from your device to our servers and then forwarded to Google's Gemini API via a third-party routing service (OpenRouter) for nutritional estimation.
  • Only the food image and an analysis prompt are sent to Google. We do not include your name, email, account ID, or any other personally identifiable information in the request to Google.
  • Google may process the image data in accordance with their API terms of service. Neither Google nor OpenRouter uses images submitted via their paid API services to train their AI models.
  • AI results are estimates only and may not be 100% accurate. Factors such as lighting, portion size, food preparation method, and hidden ingredients can affect the accuracy of the analysis.
  • You should always verify important nutritional information (e.g., for insulin dosage, severe allergies, or medical dietary requirements) with official sources or qualified medical professionals.
  • We are not responsible for any errors, omissions, or inaccuracies in AI-generated nutritional data. The AI may occasionally produce incorrect or misleading results ("hallucinations").
  • Use of this feature is entirely voluntary. You may log meals manually at any time without any image being sent to a third-party AI service.

6. AI-Generated Content Disclaimer

All nutritional estimates, meal analyses, and health insights generated by the AI features of this Application are provided on an "as-is" basis. You acknowledge that:

  • AI-generated results should be treated as approximate guidance, not definitive nutritional facts.
  • The Application provides an "Edit" function allowing you to correct any AI-generated nutritional data before saving it to your food log.
  • We implement safety filters in our AI prompts to reject inappropriate content, but no filter system is perfect. If you encounter inappropriate AI output, please report it to us immediately.
  • We reserve the right to modify, update, or change the AI models and third-party providers used for food analysis at any time. We will update our Privacy Policy accordingly if the provider changes.

7. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

8. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or application, including but not limited to reliance on AI-generated nutritional estimates or health insights. You solely assume the risk of using the application and reliance on any information provided therein, including AI-generated content.

9. Termination

We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Site (including blocking certain IP addresses), to any person for any reason or for no reason, including without limitation for breach of any representation, warranty, or covenant contained in these Terms and Conditions or of any applicable law or regulation.
